Cloud9 Party Bus Rental – Waiver & Release of Liability Effective as of: 5/13/2025 This Waiver and Release of Liability (the “Agreement”) is entered into by the undersigned individual (“Participant” or “Renter”) in consideration for being permitted to use the Cloud9 Party Bus and any related services provided by Cloud9. 1. Assumption of Risk I understand and acknowledge that participation in a party bus experience involves certain risks, including but not limited to: sudden stops, sharp turns, slips, falls, and injuries resulting from dancing, drinking, or engaging in social activities onboard. I voluntarily assume full responsibility for any and all risks of injury, damage, or loss that may be sustained while using the Cloud9 Party Bus. 2. Release of Liability I hereby release, waive, and discharge Cloud9, its owners, employees, agents, drivers, affiliates, and subcontractors from any and all liability, claims, demands, causes of action, or legal responsibility for any personal injury, property damage, or other loss sustained during or as a result of my participation on the Cloud9 Party Bus, whether caused by negligence or otherwise. 3. Alcohol Consumption Participants must be 21 years of age or older to consume alcohol onboard. I understand that Cloud9 does not provide alcohol, and assumes no responsibility for the actions of passengers who bring or consume alcohol on the bus. I agree to consume alcohol responsibly and to ensure all members of my party do the same. I acknowledge that intoxicated, disruptive, or dangerous behavior may result in early termination of the rental without refund. 4. Damage & Cleaning Fees I accept full financial responsibility for any damage to the Cloud9 Party Bus or its property caused by me or my party. I understand that cleaning fees may be applied for excessive mess, bodily fluids, or spilled substances. Minimum damage fee: $250 Cleaning fee (if applicable): Starting at $150 5. No Smoking / Illegal Substances Smoking of any kind (including vaping) and possession or use of illegal substances is strictly prohibited on the bus. Violation may result in immediate termination of service with no refund and possible law enforcement involvement. 6. Behavior & Safety I agree that all passengers must remain seated when the vehicle is in motion, use provided safety features when necessary, and follow all instructions from the driver or staff. Unsafe or aggressive behavior may result in termination of service. 7. Emergency Cancellations Cloud9 reserves the right to cancel or reschedule services in the case of emergencies, unsafe weather, mechanical failure, or other unforeseen events. In such cases, a refund or credit may be offered at the company's discretion. 8. Indemnification I agree to indemnify and hold harmless Cloud9, its employees, drivers, and affiliates from any claims, lawsuits, or damages arising from my actions or those of my guests during the rental period.
